Insanity plea saves killer twice over

MUMBAI: For the second time in close to two decades, a Mira Road resident has got the benefit of his `insanity plea` in a murder case. The Bombay high court recently acquitted the 46-year-old man, charged with murdering his building watchman in 2007. A division bench of Justices Bhushan Gavai and Sarang Kotwal said the accused, Ilyas Shaikh (name changed), had led `sufficient evidence` and a `reasonable inference could be drawn that, at the relevant time of commission of crime, he was incapable of knowing the nature of the act by reason of unsoundness of his mind and was entitled to (the) benefit of Section 84 of the Indian Penal Code.` In 2001, Shaikh had similarly been acquitted by a trial...
