Judge overturns conviction in Mandi Gray sex assault case, orders new trial

A Superior Court judge has overturned a controversial decision convicting York University student Mustafa Ururyar of sexually assaulting fellow student Mandi Gray and ordered a new trial. Ururyar had appealed his July 2016 conviction, alleging now-retired Ontario Court Justice Marvin Zuker who oversaw his trial was biased against him and gave an “illogical� analysis of the evidence.In his appeal decision, Justice Michael Dambrot criticized Zuker’s decision and reasoning as “incomprehensible� and said he failed to provide an explanation for why he rejected Ururyar’s evidence. Dambrot also said that while it was not raised at trial, he found that parts of Zuker’s decision are not properly attributed.Gray has said she does not want to testify at another trial.
