Nearly three years after he lost sight in his eye, Dafonte Miller walked past television cameras and into court Tuesday, expecting to get the chance to testify at the trial of a Toronto cop and his brother, whom he accuses of beating him bloody outside a Whitby home.The expectation that Miller would sit in the witness box had filled an expansive Oshawa courtroom on the second floor with media, members of the public and supporters of Miller and Toronto Police Const. Michael Theriault and Christian Theriault, both alleged to have brutally beaten then 19-year-old Miller on a residential Whitby street. Since the brothers were charged in the December 2016 assault, Miller, a tall and lanky man now in his early 20s, has not spoken publicly about his account of the early morning confrontation that fateful frigid day.But hours before he was expected to take the stand, his testimony was delayed due to a surprise development during the evidence of a Durham Regional police officer who was among the first to arrive on scene, finding Miller pinned down by a white man with a beard. After giving fresh information about the alleged assault, the accuracy of Const. Barbara Zabdyr’s memory was, in fact, called into question after she claimed, for the first time, that she’d heard Miller yelling out that he’d been beaten up by two men with some kind of weapon. “He was screaming that he was beat up by the males and that they were hitting him with something,” Zabdyr said she heard Miller say moments after arriving on scene.Michael and Christian Theriault are jointly charged with aggravated assault after Miller was injured in a violent altercation near the Theriault family home on Erickson Dr. Michael Theriault was off duty at the time. Miller suffered severe injuries to his eye, which had to be removed, as well as a broken orbital bone, a broken nose and a fractured wrist.Miller is expected to take the stand Wednesday.
